Terms of Service

The terms for using OpticWatch software, its licenses and the services that deliver them.

1. Who we are

OpticWatch is developed and operated by Akhzar Javed, an individual (“we”, “us”). It is not a separate incorporated company. You can reach us at [email protected].

2. What these terms cover

These terms apply to this website, the OpticWatch software in every edition (Free, Pro and Integrator), and the OpticWatch licensing service, which delivers paid downloads, activates and deactivates licenses, and sends download links. By downloading, installing or using OpticWatch, you agree to them. If you use OpticWatch for an organization, you confirm you may accept these terms for it.

3. The software

OpticWatch is self-hosted software. You download a compiled release and run it on infrastructure you control. We do not host it, operate it for you or have access to your installation, its data or your cameras.

4. Editions and licenses

Every edition may be used commercially, within its limits. Camera and site limits apply to each installation separately.

  • Free needs no license and no purchase. You may run as many separate Free installations as you need, each with up to 5 cameras and 1 site.
  • Pro is a one-time license for 1 installation with up to 100 cameras and up to 10 sites.
  • Integrator is a one-time license for up to 5 separate installations, each with up to 500 cameras and no limit on sites. Each installation is its own OpticWatch deployment with its own server, database and login; the allowance is not a pooled or multi-tenant installation.

A paid license gives you a non-exclusive, non-transferable right to install and use the paid edition you bought, on the number of installations it allows, for your own organization or on behalf of clients you serve. It is a license, not a sale of the software, and it continues without renewal or expiry for as long as you comply with these terms.

5. Activation, deactivation and moving a license

A paid installation is activated with the license key from your purchase email. Activation sends the license key and the installation’s random identifier to the licensing service, which issues a license certificate bound to that installation. After activation, normal operation does not contact us.

To move a license, deactivate it on the old installation first. Deactivation also contacts the licensing service and frees the license for another installation. If an installation has been lost, or a server has no internet access, contact us and we will help release the old installation or provide a certificate for the new one.

6. Updates

A Pro or Integrator license includes all 1.x releases of the edition you bought, at no extra cost, delivered as downloads. Whether a future major version is included will be stated before it is released. OpticWatch does not update itself; you choose when to install a release. We are not obliged to publish updates on any schedule.

7. Prices and payment

Pro and Integrator are one-time purchases priced in US dollars. There is no subscription, renewal or recurring fee. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle handles order and payment inquiries and processes returns. Paddle’s buyer terms apply to your purchase, and any applicable taxes are calculated and collected by Paddle at checkout.

8. Refunds and revocation

Refunds are described in our Refund Policy. When a purchase is refunded or charged back, its license ends: the licensing service will no longer activate it, issue a certificate for it, provide downloads for it or send recovery links. A certificate already installed on a server may continue to function, because it is verified offline, but that installation is no longer licensed to use the paid edition.

9. Acceptable use

OpticWatch is for monitoring cameras, streams, networks and infrastructure that you own, manage or are expressly authorized to monitor. You must not use it for covert or unauthorized surveillance, spyware, unlawful monitoring of people, unauthorized access, interference with third-party systems, unlawful collection of data, or any purpose that violates applicable law or another person’s rights. You are responsible for meeting the legal requirements that apply to the camera systems you monitor.

10. Restrictions

You must not:

  • share, publish or resell license keys, or use one license on more installations than it allows;
  • remove, bypass or tamper with licensing, edition limits or certificate checks;
  • redistribute paid releases, or the download links that deliver them, to anyone not covered by your license;
  • reverse engineer the software, except where applicable law expressly permits it despite this restriction.

11. Your responsibilities

You operate your installation. You are responsible for its server, security, backups, network access to your cameras, and the credentials and settings you configure. Keep your license key confidential: it appears only in your purchase email, and we cannot show it to you again.

12. Support

Questions and help with licenses, downloads and installation can be sent to [email protected]. Support is provided on a reasonable-effort basis, without a guaranteed response time.

13. Intellectual property and third-party components

The OpticWatch name, website and original software belong to Akhzar Javed. OpticWatch includes open-source components, which remain under their own licenses.

14. Disclaimer

To the extent permitted by law, OpticWatch is provided “as is” and “as available”, without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation. OpticWatch reports on stream health. It is not a safety or security guarantee, and it may not detect every failure.

15. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive losses, or for loss of data, profits, revenue or business, arising from OpticWatch or these terms. Our total liability for any claim is limited to the amount you paid for the license concerned, and for Free, which is provided without charge, to nothing.

16. Your consumer rights

Nothing in these terms limits rights you have under the consumer protection laws of the country where you live that cannot be excluded or limited by agreement.

17. Ending these terms

You may stop using OpticWatch at any time. If you materially breach these terms, including the restrictions above, your license ends and we may revoke it in the licensing service.

18. Governing law

These terms are governed by the laws of Pakistan, and the courts of Pakistan have jurisdiction over disputes about them, subject to section 16.

19. Changes

We may update these terms; the date above shows the current version. Changes do not reduce the rights of a license already purchased.
